10-Minute Grace Period Defence Letter Template
A focused appeal letter template using the 10-minute grace period as your primary defence. Covers the legal basis under the BPA Code, IPC Code, and the Parking (Code of Practice) Act 2019.
When to Use This Template
Use this template when you overstayed a paid or permitted parking period by 10 minutes or less and believe the grace period should have been applied. This defence works for both BPA and IPC member operators. It is particularly effective when the overstay was minor and the grace period was either not applied or not communicated in the signage.

[YOUR NAME] [YOUR ADDRESS] [YOUR CITY] [YOUR POSTCODE] [DATE] [PARKING OPERATOR NAME] [OPERATOR ADDRESS] Dear Sir or Madam, Re: Parking Charge Notice [PCN REFERENCE] Vehicle Registration: [VEHICLE REG] Location: [CAR PARK NAME AND ADDRESS] Date of Alleged Contravention: [DATE OF ALLEGED CONTRAVENTION] I am writing to formally appeal the above parking charge. I do not accept liability and request that the charge be cancelled on the basis that the mandatory grace period was not applied. The Grace Period Requirement Both the British Parking Association (BPA) Approved Operator Scheme Code of Practice and the International Parking Community (IPC) Code of Practice require operators to allow a minimum grace period of 10 minutes after any paid-for or permitted parking period expires before issuing a parking charge. This requirement is also enshrined in the Parking (Code of Practice) Act 2019, which mandates that the forthcoming single Code of Practice will include a grace period. The principle has been clearly established across the industry: motorists are entitled to a reasonable buffer after their parking period ends. Application to My Case According to the parking charge notice, the alleged contravention occurred at [TIME OF ALLEGED CONTRAVENTION]. My parking session [expired at / was permitted until] [EXPIRY TIME]. The difference between my permitted time and the alleged contravention time is [NUMBER] minutes, which is within the 10-minute grace period. [IF APPLICABLE: The ANPR system recorded my exit at [EXIT TIME]. Subtracting the 10-minute grace period from my recorded overstay leaves [ADJUSTED OVERSTAY], which means I was within the permitted period once the grace period is applied.] Had the operator correctly applied the grace period as required by the Code of Practice, no charge would have been issued. Signage [IF APPLICABLE: The signage at this location does not mention the grace period, which is itself a failure of the operator to communicate the full terms of parking. Motorists are entitled to know that a grace period applies.] [IF APPLICABLE: The signage states a maximum stay of [TIME] but does not clarify whether the grace period is included in or added to this maximum stay, creating ambiguity.] Conclusion I was within the mandatory grace period when the alleged contravention was recorded. The charge should not have been issued and I request that it be cancelled in full. If you reject this appeal, I will escalate the matter to [POPLA / IAS] and will cite the grace period requirement in my escalation. Yours faithfully, [YOUR NAME]
How to Use This Template
- 1
Replace all placeholders in square brackets with your actual details.
- 2
Calculate the exact overstay by comparing your parking session end time with the recorded contravention or exit time.
- 3
If your overstay was more than 10 minutes, this template may not be your strongest option. Consider using a different template with additional grounds.
- 4
Include a copy of your parking ticket or app payment confirmation showing the time you paid for.
- 5
If you have ANPR evidence showing the exact exit time, reference this in your letter.
- 6
Send within 28 days and keep a copy of everything.
Tips for a Stronger Appeal
The 10-minute grace period applies after the paid-for or permitted period expires. It does not apply to areas where parking is prohibited entirely (such as yellow lines or disabled bays without a badge).
Some operators apply a 10-minute "consideration period" at the start of a free parking period (before you buy a ticket) as well as the grace period at the end. Check whether both apply to your situation.
If the signage does not mention the grace period, this is a secondary ground for appeal: the terms were not fully communicated.
POPLA and IAS assessors are very familiar with grace period arguments and generally uphold appeals where the overstay was within 10 minutes.
If you overstayed by slightly more than 10 minutes, you can still use this defence alongside other grounds (such as signage issues or mitigating circumstances) to build a stronger case.
