When to Use This Template

I am writing to formally appeal the above parking charge notice. I do not accept liability for this charge and respectfully request that it be cancelled for the reasons set out below.

Notice to Keeper Requirements

Under Schedule 4 of the Protection of Freedoms Act 2012, the Notice to Keeper must be served within 14 days of the alleged contravention (or within 14 days of obtaining keeper details from the DVLA) in order to transfer liability from the driver to the registered keeper. I request that you provide proof that the NtK was sent within this statutory timeframe and that it contained the prescribed wording required by the Act, including the right of appeal and the consequences of non-payment. Any failure to comply with these requirements means you cannot pursue the registered keeper for payment.

Signage and Terms

Under the BPA Approved Operator Scheme Code of Practice, all terms and conditions must be clearly and prominently displayed at the entrance to the car park and at regular intervals throughout the site. The signage must include the maximum stay period, the charge amount, and details of how to appeal. I do not believe the signage at this location was adequate or compliant. Proportionality and Genuine Pre-Estimate of Loss

Following ParkingEye v Beavis [2015] UKSC 67, charges that function as penalties rather than reflecting genuine losses are unenforceable. I question whether this charge meets that threshold.

Debt Collection Practices

I am aware that UKPC uses third-party debt collection agencies whose correspondence can exaggerate the legal consequences of non-payment. I wish to place on record that I will only correspond with UKPC directly or through the formal POPLA appeals process.

I request that this charge be cancelled in full. If my appeal is rejected, I will escalate the matter to POPLA. Please respond in writing within 28 days.

If the charge relates to a residential car park, check whether the management company authorised UKPC to enforce parking and whether you were given adequate notice of the terms.

Debt collection letters from UKPC's agents often use alarming language. These are not court documents and you are not obliged to pay based on a debt collection letter alone.

Check whether the NtK arrived more than 14 days after the alleged contravention. If it did, UKPC cannot hold the keeper liable.
