I am writing to formally appeal the above parking charge. I do not accept liability and request that the charge be cancelled for the following reasons.

ANPR Evidence

Euro Car Parks relies on Automatic Number Plate Recognition cameras to determine entry and exit times. I request the full, unedited ANPR images showing my vehicle at both the point of entry and exit. ANPR systems regularly produce timing errors and misreads. Without clear, verifiable images, the charge has no proper evidential basis. [IF APPLICABLE: I believe the ANPR system may have recorded an incorrect entry or exit time, as my actual stay was within the permitted period.]

Signage and Terms

Under the IPC Code of Practice, the terms and conditions of parking must be clearly communicated through prominent signage at every entrance and throughout the car park. The maximum stay period, the charge amount for non-compliance, and the appeal process must all be clearly stated. I do not believe the signage at this location met these requirements. [DESCRIBE SPECIFIC ISSUES: e.g., signs were small, positioned where they could easily be missed, faded, obstructed by vegetation, or the maximum stay was not prominently displayed.]

POFA 2012 Requirements

Under Schedule 4 of the Protection of Freedoms Act 2012, keeper liability can only be established if a valid Notice to Keeper is served within the required timeframe and contains the prescribed information. I request evidence that the NtK was served correctly, including proof of postage and the date the DVLA provided keeper details.

Proportionality

The charge of [AMOUNT] must represent either a genuine pre-estimate of loss or serve a legitimate interest in managing the car park, as established in ParkingEye v Beavis [2015] UKSC 67. Given the nature of the alleged overstay at a [supermarket / retail park / leisure centre], I question whether this amount is proportionate.

Grace Period

The IPC Code of Practice and the forthcoming Parking Code of Practice require operators to allow a grace period of at least 10 minutes after any paid or permitted period expires. [IF APPLICABLE: If the grace period had been correctly applied, my stay would have been within the permitted time.]

I request that this charge be cancelled in full. Should you reject this appeal, I will escalate the matter to the IAS.

Tips for a Stronger Appeal

Euro Car Parks manages many supermarket and retail park sites. If you were a genuine customer, emphasise this and provide a receipt.

Check Google Street View for images of the signage at the site. Poor signage captured on Street View is powerful evidence.

Euro Car Parks charges are often based on ANPR. If you left and re-entered the site (for example, to visit multiple shops), this can result in a longer recorded stay than your actual time on site.

If the maximum stay seems unusually short for the type of site (for example, 90 minutes at a large shopping centre), this supports a proportionality argument.

Request your ANPR data via a Subject Access Request to verify the recorded times match your actual stay.
