Parking Fine on a Foreign Vehicle
Whether you are a tourist visiting the UK or a UK resident driving a foreign-registered vehicle, receiving a parking fine raises unique questions about enforcement. The rules differ significantly depending on whether the charge was issued by a private operator or a council.
Private Parking Operators and Foreign Vehicles
Private parking operators rely on DVLA keeper data to identify the registered keeper of a vehicle. However, the DVLA only holds data for UK-registered vehicles. This means:
- Operators cannot obtain keeper details for foreign-registered vehicles from the DVLA.
- Without keeper details, they cannot serve a valid Notice to Keeper (NtK) under the Protection of Freedoms Act 2012.
- Without a valid NtK, keeper liability cannot be established. The operator can only pursue the driver, and if they cannot identify the driver, they have no one to chase.
In practice, this means that private parking charges on foreign vehicles are extremely difficult to enforce. If a ticket was placed on the windscreen but the operator cannot identify you as the driver, there is very little they can do.
Council PCNs and Foreign Vehicles
Council enforcement is different. While councils also face difficulties tracing foreign keepers, they have more tools available:
- On-street fines: Civil enforcement officers can issue PCNs by affixing them to the vehicle. If the driver is present, they can be served directly.
- ANPR enforcement: London councils and other authorities use ANPR, but face the same issue of not being able to trace foreign keepers through the DVLA.
- Cross-border enforcement: Currently, there is no routine mechanism for UK councils to enforce parking fines against keepers registered in other countries. Some European countries have mutual enforcement agreements for traffic offences, but parking fines are generally not covered.
Rental Cars
If you are driving a rental car with foreign plates in the UK, the situation is different. The rental company may:
- Pay the fine and charge it to your credit card (as per the rental agreement).
- Provide your details to the operator or council.
- Add an administration fee on top of the fine amount.
Check your rental agreement carefully. Most include a clause allowing the company to pass on parking charges.
UK Residents with Foreign Plates
If you are a UK resident driving a vehicle with foreign registration, be aware that you are legally required to register the vehicle in the UK if you have been resident for more than 6 months. Driving an unregistered foreign vehicle is a separate offence. While a parking operator may not be able to trace you through the DVLA, a council or police officer may take a different view.
Practical Advice
- Private charge on a foreign vehicle: If you did not identify yourself as the driver and the operator cannot trace you through the DVLA, enforcement is very unlikely.
- Council PCN: If the PCN was affixed to the vehicle and you were not identified, enforcement is difficult but not impossible. The council may use other methods to trace you.
- Rental vehicles: Expect the charge to follow you via the rental company.
- Do not ignore a court claim: If you do receive a County Court claim form (unlikely for foreign vehicles), you must respond regardless of your vehicle's registration.
